Under the new data protection law that takes effect in May 2018 (GDPR), the Social Care Council have a number of lawful reasons that we can use to process the personal information of our existing Registrants. These are detailed in the ‘Social Care Council Privacy Statement’.
One of the lawful reasons is called ‘legitimate interests’.
Broadly speaking Legitimate Interests means that we can process the personal information of our existing Registrants if we have a genuine and legitimate reason and we are not harming any of their rights and interests.
The ‘Social Care Council Privacy Statement’ states:
In keeping with our need to achieve the lawful business objectives of our organisation, Social Care Council will periodically process the data of existing registrants to communicate information related to Social Care Council operational objectives and activities, as-well-as important Social Care sector information.
Information processed for the above purposes is therefore lawful under Article 6(1)(f) of GDPR:
– 6(1)(f) – Processing is necessary under the Legitimate Interests of the Controller
What does this mean?
We use the personal information of existing Registrants for our legitimate business interests. Before doing this however, we will carefully consider and balance any potential impact on existing Registrants and their rights.
We will process their personal information to conduct and manage our business to enable us to give them the most appropriate information and service, and provide them with the best experience of working with us.
The type of information Social Care Council will be communicating to existing Registrants under this lawful basis may include the periodic sharing of:
– Our Corporate Plan, Annual Reports, Business Plan, and other organisational information regarding the Social Care Council operations
– Information regarding our Board and staff activities
– Social Care sector reports and research conducted/published by the Social Care Council and select third-party sector partners
– Social Care sector surveys, consultations and events organised by the Social Care Council and select third-party sector partners
– Articles written by the Social Care Council or third-party social care sector partners discussing issues and best practice within the sector
When we process the personal information of existing Registrant for our legitimate interests, we will consider and balance any potential impact on them and their rights under GDPR, data protection, and any other relevant law. Our legitimate business interests do not automatically override their interests – we will not use their personal data for activities where our interests are overridden by the impact on existing Registrants (unless we have your consent or are otherwise required or permitted to by law).
In addition, existing Registrants can change the way they hear from us or withdraw their permission for us to process their personal details under the legitimate interest basis at any time.

Please note that existing Registrants cannot opt-out of receiving transactional emails related to their Social Care Council registration account.
